Service Description

Michigan Pest Control provides professional pest management and wildlife control services to residential and commercial customers throughout the State of Michigan. Our services include, but are not limited to, inspection, identification, treatment, prevention, and exclusion of common pests such as ants, termites, bed bugs, rodents, cockroaches, wasps, mosquitoes, ticks, spiders, and nuisance wildlife including raccoons, squirrels, skunks, and bats. We employ integrated pest management techniques combining chemical and non-chemical methods tailored to the specific conditions of your property, seasonal pest pressures, and applicable regulatory requirements. Treatment plans may involve one-time services, recurring maintenance programs, or emergency response visits depending on the nature and severity of the infestation. All service details, including scope of work, frequency of visits, and pricing, will be specified in your individual service agreement or work order. We reserve the right to modify our treatment protocols based on site conditions, weather, product availability, or changes in state and federal pesticide regulations.

No Guarantee or Warranty

Michigan Pest Control does not provide absolute guarantees of complete pest elimination. Pest control results depend on numerous factors beyond our reasonable control, including but not limited to: pre-existing structural conditions, neighboring infestations, climate variations, customer compliance with preparation and sanitation requirements, and the biology and behavior of target pests. While we strive to achieve optimal results using industry-standard methods and EPA-registered products, we cannot warrant that treated properties will remain entirely pest-free indefinitely. Any warranties or retreatment provisions are limited to those expressly stated in your signed service agreement, if applicable, and are subject to your full compliance with all customer obligations. Wood-destroying organism inspections and treatments are performed in accordance with Michigan Department of Agriculture and Rural Development standards and do not constitute structural warranties or real estate guarantees. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law.

User Responsibilities

As a customer of Michigan Pest Control, you agree to provide safe and reasonable access to all areas requiring treatment, including basements, crawl spaces, attics, and exterior perimeters. You must disclose known health conditions, allergies, or sensitivities of household members or pets prior to service. Children and pets must be kept away from treated areas for the duration specified by our technicians or product labels. You are responsible for securing valuables, removing food preparation items from treatment zones, and following all pre-service and post-service instructions provided. Failure to comply with these responsibilities may result in service delays, additional charges, or diminished treatment effectiveness for which we assume no liability. Commercial customers must designate an authorized representative to approve scope changes and sign for completed work. You agree to maintain accurate contact information and promptly report pest activity between scheduled visits as specified in your service agreement.

Limitation of Liability

To the fullest extent permitted by Michigan law, Michigan Pest Control and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, lost profits, personal injury, emotional distress, or damage to reputation, regardless of whether such damages were foreseeable or whether we were advised of the possibility. Our total aggregate liability for any claim arising from services rendered shall not exceed the total amount actually paid by you for the specific service giving rise to the claim within the twelve months preceding the incident. This limitation applies regardless of the theory of liability asserted, whether contract, tort, negligence, strict liability, or otherwise. You acknowledge that our pricing reflects this allocation of risk and that these limitations are essential elements of the bargain between the parties. Certain jurisdictions do not permit limitation of liability for gross negligence or willful misconduct; this limitation shall apply to the maximum extent permitted by applicable law.

Intellectual Property

All content, materials, trademarks, service marks, logos, trade dress, and proprietary information displayed on Michigan Pest Control websites, marketing materials, service reports, and documentation are the exclusive property of Michigan Pest Control or its licensors and are protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our materials without prior written consent. Customer feedback and testimonials provided to us may be used for marketing purposes with appropriate attribution. Technical information, treatment methodologies, and proprietary formulations developed or utilized by Michigan Pest Control constitute valuable trade secrets; unauthorized disclosure or use by current or former customers is strictly prohibited and may result in legal action.

Governing Law

These Terms of Service and any disputes arising from or relating to services provided by Michigan Pest Control shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of laws principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in Ingham County, Michigan, or the county where the services were primarily performed, at our election. You hereby submit to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue on the grounds of forum non conveniens or otherwise. The provisions of the Michigan Uniform Commercial Code shall apply where relevant. If any provision of these terms is held invalid or unenforceable under Michigan law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Changes to Terms

Michigan Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason, including changes in applicable law, industry standards, or our business practices. Material changes will be communicated through direct notice to active customers via email or postal mail, or by posting updated terms on our website with a revised effective date. Your continued use of our services after such modifications constitutes acceptance of the revised terms. We encourage you to review these terms periodically. If you do not agree to modified terms, you must notify us in writing and discontinue services; however, outstanding payment obligations and provisions intended to survive termination shall remain binding. Changes will not apply retroactively to disputes or incidents that arose prior to the effective date of modification.

For disputes not resolved through direct communication, we may propose mediation through a mutually acceptable neutral mediator in Michigan before either party initiates litigation, though neither party is obligated to participate in mediation for more than four hours without mutual agreement.
